NOTICE OF SALE ON FORECLOSURE PLEASE TAKE NOTICE that the above-entitled Court, having appointed me or my designee as Special Master in this matter with the power to sell, has ordered me to sell the real property (the "Property") situated in Bernalillo County, New Mexico, commonly known as 6040 Malpais Park Avenue NW, Albuquerque, New Mexico 87114, and is more particularly described as follows: LOT NUMBERED THIRTY-FIVE-P1 (35-P1), IN BLOCK NUMBERED FOUR (4) OF THE PLAT FOR PARK HILL SUBDIVISION UNIT 2, WITHIN THE TOWN OF ALAMEDA GRANT, PROJECTED SECTION 2, TOWNSHIP 11 NORTH, RANGE 2 EAST, NMPM, CITY OF ALBUQUERQUE, BERNALILLO COUNTY, NEW MEXICO, AS THE SAME IS SHOWN AND DESIGNATED ON SAID PLAT THEREOF, FILED IN THE OFFICE OF THE COUNTY CLERK OF BERNALILLO COUNTY, NEW MEXICO, ON SEPTEMBER 6, 2002, IN PLAT BOOK 2002C, PAGE 299. The sale is to begin at 10:00 a.m. on October 11, 2016, outside the front entrance to the Second Judicial District, Bernalillo County Courthouse, 400 Lomas NW, Albuquerque, New Mexico 87102, at which time I will sell to the highest and best bidder for cash in lawful currency of the United States of America, the Property to pay expenses of sale, and to satisfy the Judgment granted to BOKF, N.A. BOKF, N.A. was awarded a Judgment on August 29, 2016, in the principal sum of $112,499.04, plus outstanding interest due on the Note through June 1, 2016, in the amount of $6,152.25 and accruing thereafter at the rate of 4.375% per annum, ($13.48 per diem), plus late charges of $201.00, plus a deferred principal balance in the amount of $24,302.98, plus attorney's fees in the amount of $1,250.00 and costs in the amount of $332.27, with interest on the above-listed amounts, attorney's fees and costs at the rate of 4.375% per annum from date of the entry of the Judgment until paid. The sale is subject to rights and easements of record, to unpaid property taxes and assessments, and to the one (1) month right of redemption in favor of the Defendants as specified in the Judgment filed herein.
